Staged.Today — Terms of Service and Privacy Policy

PLEASE READ THESE TERMS OF SERVICE ("AGREEMENT" OR "TERMS") CAREFULLY BEFORE PURCHASING OR USING ANY PRODUCTS OFFERED BY STAGED.TODAY. THIS AGREEMENT SETS FORTH THE LEGALLY BINDING TERMS AND CONDITIONS FOR YOUR PURCHASE AND USE OF THE STAGED.TODAY WEBSITE AND RELATED SERVICES, INCLUDING ANY FEATURES, CONTENT, FILES, DOWNLOADS, OR PORTAL ACCESS PROVIDED FROM TIME TO TIME ("SERVICE"). BY MAKING A PURCHASE OR USING THE SERVICE, YOU AGREE TO BE BOUND BY THESE TERMS.  

"The Site" refers to the website and any subpages operated by Staged.Today, including all related features, content, and functionalities (including the customer login portal accessible via the login button on staged.today).  

Acceptance of Terms of Service  

The Service is offered subject to these Terms of Service and any additional rules, policies, or updates published by Staged.Today. By using the Service, you agree to comply with all applicable laws and these Terms.  

Staged.Today may, in its sole discretion, refuse service to any person or entity and may update its eligibility criteria or features at any time. Access to the Service is void where prohibited by law.  

Scope of Service  

Staged.Today provides digital staging services. Customers upload property photos ("Uploads"), choose one or more interior design styles, and receive staged photos ("Deliverables") created using advanced AI.  

Each order is processed as a one-time service. There are no subscriptions or recurring charges.  

Deliverables are stored and available for download for 60 days after delivery. Uploaded photos are automatically deleted from Staged.Today’s servers within 3 days of upload for privacy and security reasons.  

Customers can access their orders and downloads anytime within that 60-day period through the secure login link sent by email.  

Eligibility  

By purchasing from or using Staged.Today, you confirm that you are at least 18 years old (or the legal age of majority in your country of residence). If you are under 18 or below the digital consent age in your country, you may not use the Service.  

You are responsible for ensuring that your use of Staged.Today complies with all applicable local laws and regulations regarding digital services and content.  

Purpose and Appropriate Use  

Staged.Today’s digital staging services are intended for lawful and ethical use only. By using the Service, you agree NOT to use the Deliverables or platform to:  

1. Create or distribute misleading, fraudulent, or deceptive content.  
2. Promote illegal activities, violence, discrimination, or hate speech.  
3. Produce or assist in any pornographic or adult material.  
4. Resell, redistribute, or repackage staged photos or Deliverables in any form.  
5. Create false representations of real estate listings or properties for unlawful purposes.  
6. Use Staged.Today’s Deliverables to train AI models or automated systems without written consent.  

Deliverables may be used for personal or commercial use (e.g., property listings, marketing materials), provided such use complies with these Terms.  


User Conduct and Responsibilities  

By accessing and using Staged.Today, you agree to:  

- Use the Service only for lawful purposes.  
- Maintain the confidentiality of your email access link.  
- Not share your login link or allow others to access your Deliverables.  
- Not attempt to copy, modify, resell, or publicly distribute any Deliverables.  
- Avoid any actions that may damage, disable, or interfere with the Site or Service.  

If Staged.Today determines that you have violated these Terms, your access may be revoked immediately without refund. Legal action may be taken where appropriate.  

Content Ownership and Copyright  

All Deliverables, staging templates, and systems remain the intellectual property of Staged.Today. Purchasing or receiving Deliverables grants you a non-exclusive, non-transferable license to use the staged images for personal and commercial purposes.  

You do not own the copyright or underlying AI-generated models, data, or systems used to create the images.  

Any unauthorized resale, redistribution, or commercial exploitation of Deliverables is strictly prohibited and may result in legal action.  

License and Usage Rights  

Upon purchase, you are granted a personal and commercial license to use your staged images.  

This license allows you to:  
1. Use Deliverables in property listings, portfolios, websites, or marketing materials.  
2. Modify the images for personal or business use (e.g., cropping, resizing, text overlays).  

This license does NOT allow you to:  
- Resell or sublicense Deliverables.  
- Upload Deliverables to public datasets or image marketplaces.  
- Claim the staged design or visuals as your own original work.  
- Train or develop AI models using the Deliverables.  

All rights not expressly granted remain with Staged.Today.  

Access and File Availability  

After successful payment, you will receive an email with a secure login link to access your staged photos.  
Deliverables remain available for download for 60 days after completion. After this period, files may be permanently deleted from Staged.Today’s servers.  

Uploaded photos are automatically deleted from our system within 3 days after upload for privacy and storage reasons.  

It is your responsibility to download and safely store your Deliverables within the 60-day window. Staged.Today does not guarantee file recovery after deletion.  

Account Responsibility  

Access to Deliverables is tied to the email address used during checkout. You are responsible for maintaining access to that email and for ensuring the login link remains secure.  

Staged.Today uses password-free login via email verification (magic link). Do not share this link with others. If unauthorized access is detected, contact support immediately.  

Any shared or resold account access will result in permanent termination without refund.  

Payments  

All payments to Staged.Today are processed securely through Stripe. By completing a purchase, you authorize Staged.Today and its payment partners to process the transaction using the details you provide.  

Prices shown at checkout are final and inclusive of the selected number of photos and styles.  
All prices are displayed in the applicable currency and may vary slightly depending on exchange rates or payment provider fees.  

Staged.Today does not store or have direct access to your payment card details.  

Refund Policy  

All orders are final and non-refundable, as each staged image is generated individually for the buyer.  

Refunds or credits are not available for change of mind or mistaken orders.  
However, if the results are of clearly unacceptable quality or contain major visual errors, Staged.Today may, at its discretion, issue double the used credits as compensation.  

Refund requests must be submitted in writing within 7 days of receiving your Deliverables.  

Termination of Access  

Staged.Today may suspend or permanently revoke your access if you:  
1. Violate these Terms.  
2. Share or resell Deliverables.  
3. Misuse the Service or content for unlawful purposes.  

If your access is revoked, no refund will be issued.  

Staged.Today reserves the right to discontinue or modify any feature of the Service at any time. If discontinued, alternative access will be provided where possible for active orders.  

Disclaimers  

All Staged.Today services and Deliverables are provided "as is" and "as available".  
Staged.Today makes no guarantees regarding the accuracy, style, or creative outcome of any staged photo.  

You acknowledge that:  
- Results may vary based on the quality of your uploaded photos.  
- Colors, lighting, and object placement are generated automatically and may differ slightly from real-world expectations.  
- Delivery times are approximate and not guaranteed.  

Use of Staged.Today’s services is at your own risk.  

Limitation of Liability  

To the fullest extent permitted by law, Staged.Today, its owners, and affiliates shall not be liable for any direct, indirect, incidental, or consequential damages arising from your use of the Service or Deliverables.  

This includes, without limitation:  
- Loss of sales, listings, or revenue.  
- Errors or omissions in Deliverables.  
- Delays or interruptions in access.  
- Unauthorized access or use of your data.  

In all cases, Staged.Today’s total liability shall not exceed the total amount paid for the specific order that gave rise to the claim.  

Indemnification  

You agree to indemnify and hold harmless Staged.Today, its affiliates, and employees from any claims, damages, or expenses (including legal fees) resulting from:  
1. Your misuse of the Service or Deliverables.  
2. Your violation of these Terms.  
3. Any third-party claims arising from your use of staged images.  

No Guarantee of Results  

Staged.Today provides AI-assisted creative services and does not guarantee any specific financial, visual, or commercial results.  
Examples displayed on the website are for demonstration purposes only.  
Results depend on your input images and selected style.  

Modification of Terms  

Staged.Today may revise these Terms at any time by posting an updated version on this page.  
The new version will include a revised effective date.  
Continued use of the Service after updates constitutes acceptance of the new Terms.  

If you do not agree with the revised Terms, you must stop using the Service.  

Governing Law  

These Terms are governed by and construed in accordance with the laws of Estonia, without regard to its conflict of law principles.  
Any disputes arising from these Terms or your use of the Service shall be resolved under Estonian jurisdiction.  

Dispute Resolution  

In case of any disagreement, you agree to first contact Staged.Today at legal@staged.today to attempt an informal resolution.  
If not resolved, disputes shall be settled by binding arbitration under Estonian law.  
Arbitration shall be conducted remotely or in Estonia, and each party shall bear its own costs.  

You waive any right to participate in class actions or consolidated claims.  

Limitation Period  

Any claim or cause of action arising out of or related to your purchase or use of Staged.Today must be filed within one (1) year of the event giving rise to the claim.  
After one year, such claims are permanently barred.  

Severability  

If any part of these Terms is found to be invalid or unenforceable, that part shall be limited or removed to the minimum extent necessary so that the rest of the Terms remain in full effect.  
Failure by Staged.Today to enforce any right or provision shall not be considered a waiver of that right.  

Assignment  

You may not transfer or assign your rights or obligations under these Terms without prior written consent from Staged.Today.  
Staged.Today may assign or transfer its rights in the event of a merger, acquisition, or reorganization.

Privacy Policy  

This Privacy Policy describes how Staged.Today ("we", "our", "us") collects, uses, and protects your personal information when you purchase or access our services.  
By using our website or making a purchase, you agree to this Policy.  

1. Information We Collect  

We collect only the information necessary to process your order and deliver your files:  
- Name and email address (for file delivery and login access).  
- Uploaded photos (deleted within 3 days after upload).  
- Payment confirmation details from Stripe (we never store full card data).  
- Basic technical data such as IP address and browser type for security and analytics.  

2. How We Use Your Information  

We use your data only to:  
1. Process and confirm your order.  
2. Provide secure access to your Deliverables.  
3. Send receipts or order updates.  
4. Maintain the stability and security of our platform.  

We do not sell, rent, or share your personal data with third parties.  

3. Data Retention  

We retain only essential purchase and access data needed for your 60-day download window and legal recordkeeping.  
After this period, all non-essential data, including uploads, are permanently deleted.  

If you request deletion of your personal data, we will remove it unless retention is required for tax or legal reasons.  

4. Data Security  

We use secure servers, encryption, and access controls to protect your information.  
While we take strong precautions, no system is completely secure, and you acknowledge this risk when using our Service.  

5. Third-Party Services  

Staged.Today uses trusted third-party providers for payments (Stripe) and analytics.  
These providers process your data under their own privacy policies, which you can review on their websites.  

We are not responsible for the privacy practices of third-party services.  

6. Cookies and Analytics  

We use only basic cookies and analytics tools to monitor general website performance.  
No personal tracking or advertising cookies are used.  

7. Your Rights  

You may request:  
- A copy of your personal data stored by Staged.Today.  
- Correction or deletion of your data.  

To do so, email support@staged.today from the same address used during your purchase.  
Once verified, we will process your request promptly according to applicable laws.  

8. Children’s Privacy  

Staged.Today does not knowingly collect information from anyone under 18.  
If we discover such data, it will be deleted immediately.  

9. International Users  

Your information may be processed outside your country of residence, including in Estonia or other EU countries.  
By using the Service, you consent to this processing.  

10. Updates to This Policy  

We may update this Privacy Policy periodically.  
The most current version will always appear on this page with an updated effective date.  
Continued use of the Service after any change means you accept the revised version.

Summary  

You upload photos, we create staged results.  
Uploads are deleted within 3 days, downloads remain for 60 days, and your data stays private.

Entire Agreement  

These Terms of Service and Privacy Policy constitute the entire agreement between you and Staged.Today regarding your purchase and use of the Service.  
They supersede any prior agreements, communications, or understandings, whether oral or written.  

No partnership, joint venture, employment, or agency relationship exists between you and Staged.Today as a result of these Terms.  

Waiver of Jury Trial  

If any dispute proceeds to court instead of arbitration, both parties expressly waive any right to a jury trial.  

No Class Actions  

You agree that all disputes or claims must be handled on an individual basis.  
You may not join or participate in any class, consolidated, or representative action against Staged.Today.  

Limitation of Use  

You agree not to:  
1. Misrepresent staged images as real photographs of furnished properties if doing so violates local laws or platform guidelines.  
2. Use the Service to create misleading or fraudulent advertising.  
3. Attempt to reverse engineer or interfere with Staged.Today’s systems, automations, or APIs.  

Fair Use and Attribution  

You are not required to credit Staged.Today when publishing your staged photos, but you may not claim or imply that you created them yourself.  
If you reference the work publicly, optional credit such as "Staged with Staged.Today" is appreciated.

You retain full rights to use your staged photos commercially, but not to resell or redistribute them.
